The DMV AND DUI

Once arrested, you generally have ten (10) calendar days to request a hearing to keep your driver's license, pending the ruling on the hearing. If this deadline is missed, then it is likely that your license will be suspended. This is a very complicated area of regulations with devastating consequences. For example, the difference between a .14 Blood Alcohol Level and a .16 Blood Alcohol Level may mean increased fines and increased penalties for the defendant. I will review the police report and determine whether the arresting officers made any mistakes and whether the officers waited for the driver's blood alcohol level to rise before giving the test.
